As of September 1, 2017, a Declaration for Mental Health Treatment, can be signed before a Notary Public, or you can still sign it before two witnesses instead, for a valid document. The purpose of the document is to make a valid statement as to preferred type of restraint for health providers prior to a period of mental incapacity.  It also provides a means to allow certain medications to be used or to list those medications that are not acceptable to you.

Also effective September 1, 2017, appointment of a spouse in a Health Care Power of Attorney is voided if the marriage ends by annulment or divorce (dissolved, annulled or voided). The statutory form is restated adding explanatory language and inclusion of the new grounds for voiding of the power of attorney
